These Terms of Use are an agreement between you and Spring Madness Sim Racing Events (“Spring Madness,” “we,” “our,” or “us”). By using this website, following a registration or sponsorship link, or participating in a Spring Madness event, you agree to these terms and to any event-specific rules that apply.

1. Website Purpose

This website provides information about Spring Madness events, schedules, registration opportunities, sponsorship opportunities, policies, and related communications. Information may be updated as event plans develop.

2. Eligibility and Participant Responsibility

You are responsible for confirming that you meet all event, platform, age, payment, equipment, account, and conduct requirements before registering. If you are legally unable to agree to these terms independently, you must obtain permission from a parent or legal guardian.

You are responsible for the accuracy of information you submit and for maintaining access to any third-party account used to register, communicate, compete, receive a refund, or receive a payout.

3. Event Rules

Participation is subject to the rules, procedures, schedules, eligibility requirements, and decisions published or communicated for the applicable event. Spring Madness may enforce event rules, issue penalties, remove participants, or take other reasonable action to protect event integrity and participant safety.

4. Registration and Payments

Submitting a form does not guarantee acceptance, eligibility, or a starting position. Registration may remain subject to verification, capacity limits, deadlines, payment confirmation, and event-specific requirements.

Payments, refunds, credits, and transfers are governed by the published Refund Policy and any event-specific terms disclosed before payment.

5. Schedule and Event Changes

Spring Madness may update schedules, formats, procedures, communications, event details, or eligibility requirements when reasonably necessary. Events may be delayed, postponed, rescheduled, interrupted, or cancelled because of platform outages, technical failures, participation levels, administrative needs, emergencies, or circumstances outside the reasonable control of Spring Madness.

6. Acceptable Conduct

You may not use the website, registration process, sponsorship process, Discord channels, or event systems to submit false information, impersonate another person, interfere with operations, gain unauthorized access, distribute malicious code, harass others, commit fraud, or violate applicable law or platform rules.

7. Third-Party Services

The website may link to or rely on independent services such as iRacing, Discord, PayPal, Jotform, hosting providers, and social media platforms. Those services operate under their own terms, privacy policies, availability, and security practices. Spring Madness does not control and is not responsible for an independent service's operation or content.

8. Intellectual Property

Unless otherwise stated, the Spring Madness name, event names, logos, website design, graphics, event materials, written content, and promotional materials are owned by or licensed to Spring Madness Sim Racing Events. You may view and share public event links for personal, informational, and promotional purposes, but you may not copy, sell, alter, impersonate, or commercially exploit protected materials without permission.

Third-party names, platforms, and marks remain the property of their respective owners. Reference to a third party does not imply endorsement or ownership.

9. Participant Content and Public Competition Information

By participating, you understand that competition-related information and content may appear in broadcasts, results, standings, graphics, social posts, websites, Discord, or promotional materials. This may include an iRacing name, car number, results, statistics, in-game vehicle or livery, voice communications, or event footage.

You represent that content you submit or display in connection with an event does not violate another person's rights. Spring Madness may remove or decline to publish content when reasonably necessary.

10. Website Availability and Accuracy

Spring Madness works to provide useful and timely information but does not guarantee that the website will always be available, uninterrupted, secure, complete, or error-free. If website information conflicts with a later official event announcement, the later official announcement may control.

11. Disclaimer of Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Nothing on the website guarantees event acceptance, participation, competitive results, prize money, sponsorship results, or uninterrupted access to third-party services.

12. Limitation of Liability

To the fullest extent permitted by law, Spring Madness Sim Racing Events and its owners, administrators, staff, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, reliance on its content, participation decisions, technical failures, third-party services, or inability to access an event.

Nothing in these terms excludes liability that cannot legally be excluded. Any limitation will apply only to the extent permitted by applicable law.

13. Privacy

Information collected through registrations, communications, refunds, payouts, and event administration is handled as described in the Privacy Policy. Third-party services may separately collect information under their own policies.

14. Suspension and Termination

Spring Madness may restrict website features, deny registration, remove a participant, or end access to an administrative or event-related service when reasonably necessary to enforce these terms, event rules, payment requirements, platform rules, or applicable law.

15. Governing Law

These terms are governed by the laws of the State of South Dakota and applicable United States law, without regard to conflict-of-law principles. Any dispute will be handled in a court with lawful jurisdiction unless the parties agree to another permitted resolution method.

16. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

17. Changes to These Terms

Spring Madness may update these terms as the website, events, services, or legal requirements change. The Last Updated date will identify the current version. Continued use of the website after an update means you accept the revised terms.
